1.Acknowledgment
By accessing and participating in the 2026 National Arts Service Organization Survey ("Survey"), you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, you should not participate in the Survey.
2.Incorporation of Disclosures and Information Contained within Survey Landing Page
Additional information relating to the Survey is located within the ‘landing page’ to the Survey, accessible at: https://www.consultingadc.com/2026NationalASOSurvey. The disclosures and information contained therein is incorporated herein by reference.
3.Authority to Represent Arts Service Organization (“ASO”) and ADC’s Reliance on that Represented Authority
The individual(s) responding to the Survey on behalf of an ASO affirms that they are authorized to provide the information requested on behalf of their identified ASO. It is expressly agreed and understood that ADC will not and cannot otherwise independently verify that the individual(s) responding to this Survey on behalf of their identified ASO are authorized to complete the survey on behalf of that ASO. Should an ASO inform ADC that an individual(s) responded to the Survey on their behalf without authority to do so, ADC reserves the right to disclose to that ASO the identity of the individual(s) who responded to the Survey.
4.Eligibility
Participation in the Survey is limited to Arts Service Organizations based in the United States, Puerto Rico, the U.S. Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa who, at the time of the Survey, intend to remain open beyond December 31, 2026. “Arts Service Organizations” or “ASOs” refer to those organizations whose mission and/or programs are focused on serving the artists, arts workers and entities who deliver the arts as experiences, goods, services and meaning to communities of all types and geographic locations. ASOs can be formally incorporated organizations, collectives, or informal groups and include regranting and intermediary organizations
All other entities and individuals are ineligible to participate in the Survey. This includes, but is not limited to: (i) ASOs located outside of the United States, Puerto Rico, the U.S. Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa; (ii) ASOs that intend to close on or before December 31, 2026; (iii) individual artists or art workers; (iv) government art agencies (i.e., state arts councils or municipal arts councils that receive 100% government fundings); (v) any person in their individual capacity; and, (vi) any other entity that does not meet the definition set forth in the preceding paragraph.
5.Voluntary Participation
Participation in the Survey is entirely voluntary. You may choose to discontinue your participation in the Survey or decline to answer specific questions at any time before submitting your responses, unless otherwise stated.
6.Purpose of the Survey
The Survey is a first-of-its-kind effort to collect information on ASOs operating in the United States today. It is a part of ADC’s multi-phase research study Understanding Arts Service Organizations in a Changing Arts Ecosystem (“the Study”), which aims to understand the role, impact, and ongoing evolution of ASOs. The purpose of the Survey is, in part, a recognition of the importance of data as a public utility for ASOs and to permit ASOs and the sector at large to utilize that public data to find other ASOs with which to work and collaborate. 7.Non-Anonymity, Purpose of Responding to the Survey, and Use of ASO Information in Data Set
Responses to the Survey are not anonymous. ASOs will be required to disclose their name and other details about their operating conditions. Data collected will be reviewed, cleaned, and normalized. Some of the data will be shared publicly via the National ASO List & Data Tool, a publicly available open-source database and made available for download. It is anticipated that the National ASO List & Data Tool will remain publicly available years and, in fact, there is no set time when it is anticipated that the National ASO List & Data Tool will be deactivated. The individual completing the survey will also be required to provide their contact information, however, their contact information WILL NOT be shared publicly and will only be used if you give us permission to reach out to you with questions and/or if an ASO informs ADC that information about it was provided by an unauthorized individual(s).
Raw data will not be shared publicly. The raw data will be reviewed by the ADC Consulting Research Team (including, but not limited to: Alejandra Duque Cifuentes, Carrie Blake, Leonardo Figueiredo, Maleni Palacios, Augustine Jiminez, and Yon Mi Kim). Raw data for questions3.1b, 3.4a, 3.6, 3.6a for New York State-based ASOs will be made available to our Survey Research PartnerVoices for Creative New York.
8.Very Limited Ability To Rescind or Amend Survey Submission
Organizations can request to have their survey submission rescinded until October 15, 2026 by contacting research@consultingadc.com. Once that deadline has passed, the survey responses will be incorporated into the data set as submitted and there will be no ability to rescind the Survey responses.
Submitted survey data cannot be changed. If you wish to change the data on a survey that has already been submitted you will need to submit a new survey with the updated information and contact ADC Consulting at research@consultingadc.com to confirm your preferred submission prior to October 15, 2026. If you do not contact ADC Consulting about your preferred submission, ADC Consulting will select the most recent or most completed version of the data you submit. All other submissions will be destroyed.
9.Disclaimers
To the fullest extent permitted by law, ADC disclaims all warranties, express or implied, regarding the availability, accuracy, or reliability of the data set that is output from the Survey.
It is further agreed and understood that:
a) ADC cannot independently verify that individual(s) responding to the Survey on behalf of an ASO are doing so with the authority of the ASO or that the individual(s) responding to the Survey on behalf of an ASO are the best positioned to respond on behalf of that ASO.
b) ADC cannot independently verify that the data provided on behalf of ASOs is accurate.
c) ADC cannot guarantee that that data set that is output from the Survey is representative of the entire universe of ASOs across the United States and/or of a particular geographic region within the United States. Nor can ADC guarantee that the data set that is output from the Survey is not otherwise skewed due to factors beyond the control of ADC.
d) ADC cannot guarantee that the ASOs that elect to participate in the Survey will be a representative sample of ASOs in the United States and/or within a particular geographic region.
e) Data limitations beyond the control of ADC can impact the quality of the data set, including but not limited to the number of respondents to the Survey.
f) ADC expressly disclaims that the data set that is output from the Survey will be fit for a particular purpose for an ASO. ADC further expressly disclaims that any independent decisions made by an ASO based upon that ASO’s review of the data set that is output from the Survey will benefit the ASO. It is understood that ASOs will use the data and information output from the Survey at their own risk, bearing full responsibility for their own decisions.
10.Reservations on Use of Survey Responses
ADC reserves the right to exclude from the data set any information provided by any ASO for any reason, at its sole discretion.
ADC reserves the right to not publish any data output from the Survey for any reason, at its sole discretion.
11.Intellectual Property
All original, underlying information provided on behalf of an ASO remains the property of the ASO.
The resulting compilation of raw data of all Survey responses that has been reviewed, cleaned, and normalized is exclusively owned by ADC. ASOs responding to the Survey explicitly relinquish all rights and claims to the same by participating in the Survey.
Each ASO responding to the Survey retains all right, title, and interest – including all intellectual property rights – in and to the original underlying information, data, materials, and other content submitted by the ASO in response to the Survey ("Underlying ASO Data").
Each ASO responding to the Survey grants ADC a worldwide, perpetual, irrevocable, royalty-free license to collect, use, reproduce, store, process, modify, normalize, standardize, aggregate, analyze, adapt, publish, and otherwise distribute the ASO Data for the purpose of creating and maintaining datasets; producing reports, analyses and other outputs; conducting research, and for other purposes consistent with the Survey and the Study. Without limiting the foregoing, ADC shall exclusively own all right, title, and interest – including all intellectual property rights – in and to the clean and normalized dataset created from the Survey responses (“Survey Dataset”), together with all associated ADC work product, including but not limited to databases, methodologies, compilations, analyses, reports, summaries, findings, conclusions, statistical outputs, datasets, visualizations, and other derivative works or materials created by or on behalf of ADC (“ADC Work Product”). For the avoidance of doubt: no right, title, or interest of any other intellectual property right in the Survey Dataset or the ADC Work Product is being conveyed by ADC to any ASO participating in the Survey. Nothing herein shall be construed as limiting ADC’s ability to subsequently publicly share some or all of the Survey Dataset and/or ADC Work Product via creative commons license or other means, at its sole discretion.
12.Views and Representations
The Survey Dataset and ADC Work Product are intended solely to reflect the views, opinions, and analyses of ADC. The Survey Dataset and ADC Work Product do not represent, and shall not be construed as representing, the views, opinions, or positions of any other individual or entity, including but not limited to any entity providing funding for the Survey and/or the Study, any ASO, any Survey Research Partner or Survey Communications Partner assisting ADC, or any other third-party.
13.Incentives
It is acknowledged that some ASOs have been offered the opportunity to be entered into a Raffle for completing the Survey and/or participating in Survey Taking Parties. The terms and conditions relating to the Raffle are set forth separately.
14.Survey Participant Responsibilities
Individuals responding on behalf of an ASO agree to:
Review the Informed Consent page, review the Terms and Conditions, and review the FAQs before providing responses.
Provide accurate and honest responses, to the best of their ability.
Refrain from submitting information that is unlawful, defamatory, infringing, or otherwise inappropriate or to which the respondent does not have the legal authority to provide.
Cooperate in good faith with any reasonable requests by ADC or its agents clarify or verify information submitted;
Promptly notify ADC if it becomes aware of any material error or omission in the information it has provided prior to October 15, 2026 or if it becomes aware that it has submitted information that is unlawful, defamatory, infringing, or otherwise inappropriate or to which the respondent does not have the legal authority to provide.
15.Questions Relating to the Survey, Technical Issues, and Technical Limitations
If the Survey participant experiences technical issues or otherwise has questions relating to the Survey, the Survey participant can email questions to research@consultingadc.com. ADC will make reasonable efforts to respond to questions within 2-3 business days. It is expressly understood that responses may take longer and that a response may not be provided for any reason whatsoever, at ADC’s discretion.
It is expressly understood that some technical difficulties experienced by a Survey participant might be related to issues that are beyond the control of ADC, including but not limited to Jotform’s technology or the Survey participant’s browser, operating system, internet connection, and/or hardware. While ADC will do its best to address any questions within its capacity, limitations beyond the control of ADC may limit and/or prevent an ASOs ability to respond to the Survey.
16.Limitation of Liability
To the fullest extent permitted by applicable law, ADC shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to the Survey and/or any individual completing the Survey while representing that they have authority to do so on behalf of an ASO.
17.Governing Law and Venue
These Terms and Conditions and Informed Consent Waiver shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. The exclusive jurisdiction for any dispute arising from these Terms and Conditions, the Informed Consent Waiver, or the participation in the Survey is the state courts of State of Washington with jurisdiction over the County of Thurston or the U.S. District Court for the Eastern District of Washington.
18.Entire Agreement
These Terms and Conditions, together with the acknowledged Informed Consent, constitute the entire agreement between the ASO and ADC regarding participation in the Survey.
